Buyer agrees to indemnify and hold harmless Aloe Plus International, its employees, agents, successors, officers, and assigns, from and against any suits, losses, claims, demands, liabilities, costs, and expenses (including attorney and accounting fees) that Aloe Plus International may sustain or incur as a result of any claim against it based upon negligence, breach of warranty, strict liability in tort, contract, or any other theory of law brought by Buyer, its officers, agents, employees, successors or assigns, by Buyer’s customers, by end users, by auxiliary personnel (such as freight handlers, etc.) or by other third parties, arising out of, directly or indirectly, the use of Aloe Plus International products, or by reason of failure to perform its obligations contained herein.
At buyer request, Aloe Plus International may, at its own discretion, supply technical assistance and information with respect to products. Aloe Plus International makes no warranties of any kind or nature – expressed or implied – including any implied warranty of merchantability or fitness for any particular purpose, with respect to technical assistance or information provided by Aloe Plus International or its personnel. Any suggestions by Aloe Plus International regarding use, selection, application, or suitability of the products shall not be construed as an express warranty, unless specifically designated as such in writing and signed by an officer or other authorized representative of Aloe Plus International.
Further, Aloe Plus International is not responsible for the comments made in the customer reviews, nor when products are used in ways not suitable to their purpose (for example, fragrance oils in toothpaste; bath salts in metal containers; additives used in larger amounts than recommended). As with any manufacturing process, Aloe Plus International strongly recommends small lab scale testing for evaluation purposes, prior to full commercial manufacturing. Please note, the International Federation of Aromatherapists do not recommend that Essential Oils be taken internally, unless under the supervision of a Medical Doctor, who is also qualified in clinical Aromatherapy. In addition, Essential Oils must be properly diluted before use, in order to avoid any damages to property or adverse physical effects (including injury or bodily harm).
